Terms of Service

Effective date: 10 August 2026Last updated: 10 August 2026

These terms are an agreement between you and Frozen Crow Inc., 3744 E. Chapman Ave., Ste #F12358, Orange, CA 92859, United States (“Frozen Crow”, “we”, “us”), covering your use of MenuCast — the website at menucast.app, the customer dashboard, the design editor, and the MenuCast display apps (together, the “Service”).

By creating an account or using the Service, you agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

1. What MenuCast does

MenuCast is digital signage software. You build designs (single screens of content), group them into playlists (rotations with a duration for each design), and assign a playlist to a screen (a television or media player in your venue running the MenuCast app). Your screens check for updates roughly once a minute and display whatever their playlist contains.

We provide the software and the hosting. You provide the hardware — the televisions, the media players, the internet connection — and the content.

2. Your account

You need an account to use the Service. You agree to give accurate information, keep your password confidential, and tell us promptly if you think someone else has access to it. You are responsible for what happens under your account, including anything done by people you give access to.

Accounts are for businesses. You must be at least 18 and legally able to enter a contract.

3. Plans, billing, and extra screens

Subscriptions

The Service is sold on a subscription. Current plans, prices, and how many screens each includes are shown at menucast.app/pricing. Subscriptions renew automatically — monthly or annually, whichever you chose — until you cancel. Payment is processed by Stripe; by subscribing you authorise us to charge your payment method on each renewal.

Extra screens

Each plan includes a number of screens. If you pair a screen beyond that number, it is added to your subscription automatically and you are charged a prorated amount immediately for the rest of the current period, at the per-screen price for your plan. We tell you the price before you pair.

If you remove a screen, we stop billing for it straight away and credit the unused portion against your next invoice. You should never keep paying for a screen you have taken down; if you think you are, tell us and we will fix it.

Failed payments

If a payment fails, your screens keep playing and your account enters a grace period during which editing is paused. Update your payment method to restore it. If the subscription is not brought current, we may suspend the account, at which point screens stop displaying your content.

Cancelling and refunds

You can cancel at any time from your billing page. Cancellation takes effect at the end of the period you have already paid for; we do not provide partial refunds for unused time on a cancelled subscription, except where the law requires it or where we have got something wrong. If you believe you have been charged in error, contact us — we would rather sort it out than argue about it.

Price changes

We may change prices. Existing customers get at least 30 days’ notice by email before a change affects them, and you may cancel before it takes effect.

4. Your content

You own your content. Designs, images, menus, prices, logos, and anything else you upload remain yours. We claim no ownership of it.

You grant us a licence to host, copy, reformat, and transmit your content — including rendering it into images and delivering it to your screens — solely to provide the Service. That licence ends when you delete the content or close your account, except for backups that age out on the schedule in our Privacy Policy.

You are responsible for having the right to use what you upload. Do not upload content you do not have permission to use, including photographs, fonts, logos, and music you have not licensed.

Published designs are publicly accessible

When you publish a design, the resulting image is stored at a public web address so your screens can fetch it without logging in. The address is long and unlisted, but it is not password-protected and not secret. Do not put confidential or personal information in a design.

Stock photos

The design editor can search public-domain and CC0 photographs through Openverse. These are provided as a convenience. While such images are generally free to use commercially without attribution, you are responsible for confirming the licence of any image you publish, and we make no warranty about the rights attached to third-party images.

5. Acceptable use

You agree not to use MenuCast to display, store, or transmit anything that:

  • is unlawful, or promotes unlawful activity;
  • infringes someone else’s intellectual property or privacy;
  • is defamatory, harassing, or hateful;
  • is obscene, or harmful to minors;
  • misrepresents prices or terms in a way that deceives consumers; or
  • contains malware or attempts to compromise any system.

You also agree not to reverse-engineer the Service, resell access without our written agreement, use it to build a competing product, or place unreasonable load on our infrastructure.

We may remove content or suspend an account that breaches this section. Where practical we will tell you first and give you a chance to fix it.

6. Availability

We work to keep MenuCast running, but we do not promise uninterrupted service. Maintenance, third-party outages, internet problems, and hardware failures happen. We do not currently offer a service level agreement or uptime guarantee.

Your screens keep displaying the content they last downloaded when they lose connectivity, so a brief outage does not usually blank your venue. That behaviour is a design choice, not a guarantee.

7. Third-party services

The Service relies on third parties including Stripe for payments, GoHighLevel for customer support records, and our hosting provider. Your use of MenuCast is also subject to their terms where they apply directly to you. We are not responsible for their acts or omissions, but we will make reasonable efforts to choose providers carefully and to tell you about changes that affect you.

8. Our intellectual property

The Service — its software, design, and branding — belongs to Frozen Crow Inc. These terms grant you a limited, non-exclusive, non-transferable right to use the Service while your subscription is current. Nothing here transfers ownership of anything to you.

Feedback you send us is welcome and we may use it without obligation or payment.

9. Suspension and termination

You may close your account at any time.

We may suspend or terminate an account that breaches these terms, fails to pay, or is used in a way that risks harm to other customers or to us. Except where a breach is serious or ongoing, we will give notice and an opportunity to fix the problem.

On termination your right to use the Service ends and your screens stop displaying content. See our Privacy Policy for how long data is retained afterwards; you can export or download what you need before closing.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, that it will meet your requirements, or that content will always display exactly as designed on every screen or device.

You are responsible for the accuracy of what you display, including prices, allergen information, and any legally required notices. MenuCast is a display tool; it does not check your content for accuracy or compliance.

11. Limitation of liability

To the fullest extent permitted by law:

  • Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
  • Our total liability arising out of or relating to these terms or the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.

12. Indemnity

You agree to indemnify and hold harmless Frozen Crow Inc. and its officers and employees from claims, damages, and reasonable legal costs arising from your content, your use of the Service, or your breach of these terms.

13. Resolving disputes

If something goes wrong, contact us first — most problems are quicker to fix than to argue about. Email us with the details and we will work with you in good faith for at least 30 days.

If that does not resolve it, these terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and both parties submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California. Nothing prevents either party from bringing a claim in small claims court, or from seeking injunctive relief to protect intellectual property.

14. Changes to these terms

We may update these terms. For material changes we will give account holders at least 30 days’ notice by email, and continuing to use the Service after they take effect means you accept them. If you do not accept, you may cancel before the change applies.

15. General

These terms, with the Privacy Policy, are the whole agreement between us about the Service. If any provision is unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor in a merger or sale of the business.
